Terms of subscription purchases and recurring payments
The provider enables the purchase of selected products in the form of a subscription, whereby the buyer receives the selected products periodically at pre-defined time intervals.
A subscription purchase is available only for products that are specifically marked as such. Delivery frequency, billing frequency, price of the first order, price of subsequent orders, discounts, possible gifts, free delivery, and other benefits are displayed for each subscription product and at checkout.
By placing an order for a subscription purchase, the buyer confirms that they are familiar with these terms and agrees:
- that the order is automatically renewed at the selected time interval,
- that payment is executed according to the selected payment method,
- that for payment methods allowing recurring charges, the selected payment card or other payment method is automatically charged before each subsequent shipment of the order,
- that in the case of cash on delivery, the next periodic order is additionally confirmed prior to dispatch in accordance with these terms,
- that the product will be delivered at the selected time interval until the subscription is cancelled,
- that the subscription is carried out in accordance with these Subscription Purchase Terms and the provider’s applicable Terms and Conditions.
Delivery and billing frequency
The frequency of delivery and billing is determined according to the selected subscription package and is shown for each subscription product and at checkout.
A subscription order is generally renewed at the interval selected by the buyer when the subscription is entered into, for example every 30, 60, or 90 days, unless the buyer cancels, modifies, pauses the subscription, or the provider suspends or cancels the subscription in accordance with these terms.
Payment for subscription orders is made according to the selected payment method. For payment methods that allow recurring charging, payment is processed automatically before each subsequent shipment. In the case of cash on delivery, the next periodic order must be additionally confirmed prior to dispatch in accordance with these terms.
The buyer receives a notification of a successfully placed initial order as well as notifications related to the processing of subsequent subscription orders to the email address provided at purchase.
The provider may notify the buyer via email before each subsequent recurring payment or shipment. The notification may include information about the upcoming order, ordered products, price, discounts, order processing date, and expected dispatch.
Cash on delivery for subscription purchases
If the provider enables cash on delivery for subscription purchases, payment is made upon delivery of each order in accordance with the selected payment method.
For subscription purchases with cash on delivery, the buyer receives a notification to the email address provided at purchase before each subsequent periodic order is dispatched. The notification is usually sent 3 days before the expected shipment and contains information about the upcoming order and the option to confirm it.
The buyer must confirm the order within the timeframe and in the manner specified in the email notification. If the buyer does not confirm the order via email, the provider or call center may contact the buyer by phone for the purpose of order confirmation.
If the buyer does not confirm the order via email or phone call, the provider reserves the right to hold the order, not dispatch it, skip a subscription period, temporarily suspend the subscription, or cancel the subscription.
The buyer is responsible for providing accurate and up-to-date contact information, including email address and phone number. The provider is not liable for non-execution or delayed dispatch if the buyer fails to confirm the order in time due to incorrect, incomplete, or unavailable contact information.
Prices, discounts and benefits
The subscription purchase price, discounts, and any benefits are displayed for each product and at checkout.
For subscription purchases, the provider may grant the buyer special benefits such as a lower product price, additional discounts, free shipping, exclusive promotions, gifts, or other benefits stated in the offer.
If it is stated for a subscription product that the buyer saves an additional 20% on all orders starting from the second order, the additional 20% discount applies to the second and all subsequent recurring orders as long as the subscription is active or until the offer is changed in accordance with these terms.
A discount that applies from the second order onward does not necessarily apply to the first order unless explicitly stated in the individual offer. The price of the first order and the pricing or billing method of subsequent orders are shown to the buyer before placing the order.
Discounts and benefits may depend on the selected subscription package, delivery frequency, subscription duration, order sequence, order value, or other conditions stated in the individual offer.
Each benefit may apply only to the first order, the second order, a specific subsequent order, or all recurring orders, as specified in the offer.
If it is stated that the price, discount, or other benefit changes in subsequent orders, the applicable price or benefit will be the one shown to the buyer at the time of subscription or the one communicated to the buyer in a timely manner.
The provider reserves the right to change subscription prices, discounts, benefits, delivery costs, or other subscription terms. The buyer will be informed of any change affecting the price or essential terms at least 15 days before it takes effect.
The buyer may cancel the subscription at any time before the changes take effect. If the subscription is not cancelled before the changes take effect, the buyer is deemed to agree to the new price or modified terms.
Free delivery
If free delivery is stated for a subscription purchase, this benefit applies in accordance with the terms of the individual offer.
Free delivery may apply to the first order, all subscription orders, or only specific orders, if stated in the offer.
The provider reserves the right to change free delivery conditions for future orders, with the buyer being informed at least 15 days before the change takes effect.
Gifts with subscription purchases
The provider may provide a gift, free product, or other promotional benefit with a specific subscription offer.
If it is stated that the buyer receives a gift with the first or current order, the gift is sent only once, together with the first order, unless otherwise explicitly stated.
The gift is not sent again with the second or subsequent recurring orders unless explicitly stated in the offer.
Gifts, free products, and promotional benefits may be limited in quantity or time. If the gift is no longer available, the provider reserves the right to replace it with a comparable gift or benefit or to terminate the promotion.
If the buyer withdraws from the contract or returns an order for which a gift was received, the buyer must also return the gift, unless otherwise specified. If the gift is not returned, the provider reserves the right to deduct its value from the refund.
Subscription cancellation
The buyer may cancel the subscription at any time:
- via the user account, if available,
- via a link in an email message, if available,
- or by written notice to the provider’s email address.
Cancellation applies to future orders and does not affect orders that have already been processed, paid, prepared for dispatch, or shipped before cancellation.
If an order has already been processed, paid, prepared for dispatch, or shipped before cancellation, general delivery, return, and withdrawal rules set out in the provider’s Terms and Conditions apply.
Subscription cancellation does not automatically constitute withdrawal from a contract for already completed orders. To withdraw from a contract or return products, the buyer must follow the withdrawal and returns provisions.
Modification, temporary suspension, or skipping of subscription
The provider may allow the buyer to manage the subscription via a user account or other online interface, if such functionality is available.
The buyer may, if available, change delivery frequency, product quantity, delivery address, billing details, payment method, temporarily suspend the subscription, reactivate the subscription, or skip the next order.
Subscription changes apply to future orders if made in time before the next order is processed.
If the next order has already been processed, paid, prepared for dispatch, or shipped, the change will apply only to the next subscription period.
Failed payment
The buyer is responsible for ensuring the accuracy, validity, and sufficient availability of funds on the selected payment method.
In the event of a failed payment attempt, the provider may:
- attempt to charge the payment method again,
- notify the buyer of the failed payment,
- temporarily suspend order processing or delivery,
- temporarily suspend the subscription or cancel it.
Until payment is successfully completed, order processing and delivery may be temporarily suspended.
The provider is not liable for delivery delays resulting from failed payments, incorrect payment details, expired cards, bank payment rejection, or other payment service provider issues.
In the case of cash on delivery, refusal to accept the order or failure to pay upon delivery is also considered a failed payment. In such cases, the provider reserves the right to suspend the subscription, skip future orders, cancel the subscription, or restrict further subscription purchases with cash on delivery.
Right of withdrawal and returns
The buyer has the right to withdraw from the contract in accordance with applicable legislation and the provider’s Terms and Conditions.
If the provider’s Terms and Conditions grant a longer withdrawal or return period, this more favorable period also applies to subscription purchases unless otherwise explicitly stated.
The consumer may withdraw from the contract within the period defined in the applicable Terms and Conditions, except where withdrawal is excluded under applicable law and these terms.
Returns are not possible for sealed products which are not suitable for return due to health protection or hygiene reasons if the seal has been broken after delivery, as well as in other cases defined by applicable law and the Terms and Conditions.
For already completed recurring deliveries, cancellation of the subscription does not automatically constitute withdrawal from the contract for orders already processed, paid, prepared for dispatch, or shipped.
Stock and product availability
Subscription orders are fulfilled subject to product availability.
If a product is temporarily out of stock, the provider may temporarily suspend order processing, notify the buyer of the delay, offer a comparable substitute product, or temporarily suspend or cancel the subscription.
If a product is permanently unavailable, the provider may cancel the subscription and notify the buyer accordingly.
User account and buyer data
To facilitate subscription management, the provider may allow the buyer access to a user account or other online interface where the buyer can view, modify, temporarily suspend, reactivate, skip, or cancel the subscription, if such functionality is available.
The buyer is required to ensure that their contact details, email address, phone number, delivery address, billing information, and payment details are accurate, valid, and up to date.
The provider is not responsible for failed delivery, delayed delivery, or failure to notify the buyer if this results from incorrect, incomplete, or outdated information provided by the buyer.
Notifications to the buyer
All notifications related to subscription purchases, including order confirmations, notifications about upcoming orders, COD confirmations, price changes, failed payments, changes to terms, or subscription cancellation, may be sent to the email address provided by the buyer at purchase.
The buyer is responsible for providing a valid email address and phone number to the provider and for regularly checking received notifications.
Restrictions and misuse
The provider reserves the right to refuse, suspend, or cancel a subscription purchase if it detects misuse of the subscription system, unauthorized use of discounts, unauthorized receipt of gifts, repeated failed payments, non-collection of cash-on-delivery orders, suspected fraud, or other conduct contrary to these terms, the Terms and Conditions, or applicable law.
Relationship to Terms and Conditions
For all matters not specifically regulated in these Subscription Purchase Terms, the provider’s applicable Terms and Conditions, Privacy Policy, and other rules published on the provider’s website shall apply.
In case of inconsistency between these Subscription Purchase Terms and the general Terms and Conditions, these specific terms shall prevail for subscription purchases unless otherwise more favorable to the buyer.
Personal data protection
Data related to subscription purchases, recurring payments, order processing, delivery, COD confirmations, customer notifications, and subscription management are processed in accordance with the provider’s Privacy Policy and applicable personal data protection legislation.
